1. About these terms
These Terms of Service form a binding agreement between you and Company Name, commercial registration CR Number, registered at Registered Address (“SaltWater”, “we”). By creating an account or making a booking you accept these terms.
2. Our role is a marketplace
SaltWater connects guests with independent providers who own or operate boats, jet skis, beach houses and sea activities. The provider — not SaltWater — supplies the experience, holds the required licences and insurance, and is responsible for its safe delivery. Your booking contract for the experience is with the provider; your contract with us covers use of the platform and payment facilitation.
3. Eligibility and accounts
- You must be at least 18 years old and legally able to enter contracts.
- You must provide accurate registration details and keep your credentials confidential.
- One person may not operate multiple accounts to circumvent limits, reviews or suspensions.
- We may suspend or close accounts that breach these terms, applicable law or the safety rules of a provider.
4. Bookings and pricing
- Prices are shown per hour, day, night, trip, person or session as listed and are stated in Display Currency.
- The total at checkout includes the service fee and any taxes shown. VAT treatment and rate per country.
- A booking is confirmed only when payment is accepted and a booking reference with QR code is issued.
- Providers may set minimum age, weight, licence, swimming-ability or guest-count conditions. Meeting them is your responsibility.
5. Payments
Card payments are processed by Payment Processor. We do not store full card numbers. Payouts to providers are made under the Provider Terms after the service date, less the platform commission of Commission Rate.
Launch note: a live card gateway must be connected and PCI-scoped before real payments are accepted.
6. Cancellations and refunds
Cancellations, weather disruptions, no-shows and refunds are governed by our Refund & Cancellation Policy, which forms part of these terms.
7. Guest conduct
- Follow all safety briefings, captain instructions and marina or beach regulations.
- Do not board or operate any craft under the influence of alcohol or drugs.
- Respect local law and public decency standards in the country you are visiting.
- You are responsible for damage caused by you or your guests to a vessel, property or equipment.
8. Reviews, messages and content
You may publish reviews and photos only for experiences you actually booked, and only content you own the rights to. We may remove content that is unlawful, misleading, offensive or off-topic. You grant us a non-exclusive licence to display your content on the platform.
9. Limitation of liability
To the fullest extent permitted by law, SaltWater is not liable for the acts, omissions, seaworthiness, licensing or negligence of a provider, nor for indirect or consequential loss. Our aggregate liability for any claim is limited to Liability Cap. Nothing in these terms excludes liability that cannot be excluded under applicable law. Lawyer review: liability cap enforceability in KSA/UAE.
10. Governing law and disputes
These terms are governed by the laws of Governing Law Jurisdiction and disputes are subject to Courts / Arbitration Forum. Consumers keep any mandatory rights available in their country of residence.
